How Eligible U.S. and Mexican citizens can Take benefit from Canada-United States-Mexico Agreement or CUSMA

Workers, traders, and investors of USA and Mexico now can come to Canada to work, trade and invest in Canada without LMIA (Labour Market Impact Assessment).


What is LMIA?

In this process, a Canadian employer wishing to hire a foreign worker first need to receive government approval before hiring a foreign worker

This is processed under the Labour Market Impact Assessment (LMIA), formerly known as a Labour Market Opinion (LMO).

In order to receive an LMIA, It must be determined that the hiring of a foreign worker will have a positive effect on the Canadian labour market. Also, it must be proven that no qualified Canadians meet up the requirement in favour of the foreign worker and the foreign worker will receive a salary and benefits that meet federal and provincial standards.

This programme was known as the North American Free Trade Agreement, or NAFTA before July 2020.

It was a free-trade programme held in North America; was signed in 1992 by Canada, Mexico, and the United States

NAFTA cuts tariffs on most agricultural products traded among these countries.  It was implemented in order to promote trade between the U.S., Canada, and actually went into effect on January 1, 1994.

Eligibility requirement for each category: 


CUSMA professionals:

Need to have a pre-arranged job in Canada or contacts in Canada in the target profession

Target professions: there are more than 63 professions including Accounts, Medicine, science and more.


CUSMA traders: eligible candidate must demonstrate an intention to carry out substantial trade of goods or services between Canada and his or her country of citizenship (US or Mexico). more than 50 per cent of the trade must be done between Canada and one of these countries.

CUSMA investors:  these candidates must demonstrate that they have made a substantial investment in a new or existing Canadian business and they are seeking entry to Canada to develop and direct the Canadian business.


CUSMA intracompany transfers: CUSMA Intra-Company Transferees are who already worked in US or Mexico and now it is transferred to Canada on a temporary basis to work for a branch or their US or Mexican employer. According to The Canadian Border Services Agency, If anyone applying to obtain the CUSMA work permit from any other country from this world has to go through different procedures to make an application for a permit and receive authorisation to travel from  IRCC that will help to obtain legal entry to Canada.
